1. Agreement to Terms

By placing an order for documents or services through the Spearhead Property Management website (the “Site”), you agree to be bound by these Terms and Conditions. These terms apply to all users, including condominium owners, legal representatives, real estate agents, and financial institutions.

2. Refund and Cancellation Policy (Strict No-Refund)

Due to the time-sensitive, administrative, and legal nature of the documents we provide (including but not limited to Status Certificates, Insurance Certificates, and disclosure documents), all sales are final.

  • Compensation for Service: You acknowledge that the fee paid serves as compensation for the immediate allocation of administrative resources and the search of corporation records.
  • No Refunds: Refunds will not be issued once an order has been submitted and payment has been processed, regardless of whether the related real estate transaction (sale, purchase, or refinance) closes.
  • No Cancellations: Because our system often triggers immediate workflow steps to expedite delivery, cancellations are not permitted once an order is placed.

3. Order Accuracy & Purchaser Responsibility

The purchaser is solely responsible for ensuring the accuracy of all details entered during the ordering process. This includes:

  • The Condominium Corporation Number (e.g., TSCC, YRCC).
  • The Civic Address, Unit Number, and Level Number.
  • The email address for digital delivery.

Spearhead Property Management is not responsible for errors made by the purchaser. Documents generated for incorrect units or corporations cannot be exchanged, corrected, or refunded. If an order is placed for the wrong unit, a new order must be placed and paid for in full.

4. Delivery of Documents

  • Statutory Timelines: For Status Certificates, we adhere to the timelines prescribed by the Condominium Act (typically within 10 days of receipt of payment), unless a specific “Rush” or “Expedited” service is selected and paid for.
  • Method of Delivery: Unless otherwise specified, all documents are delivered digitally to the email address provided at checkout.
  • Delays: Spearhead Property Management is not liable for delays caused by technical issues with the purchaser’s email provider (e.g., firewalls, spam filters) or incorrect email addresses provided at checkout.

5. Limitation of Liability

The documents provided are based on the current records of the Condominium Corporation at the time of issuance. Spearhead Property Management Ltd. assumes no liability for any subsequent changes to the status of the unit or corporation after the document has been issued.

6. Exceptions for Technical Errors

We reserve the right to issue a refund solely in the event of a verified technical error on our part, such as:

  • A duplicate charge processed by the payment gateway for a single transaction.
  • Non-delivery of the product due to a system failure on our end (provided the purchaser has contacted us to attempt resolution first).
